Terms of Use

Genealogical DNA Analysis Tool is an App developed by Beckins LLC. 

PLEASE READ THIS TERMS OF USE AGREEMENT (THIS "AGREEMENT") CAREFULLY. BY DOWNLOADING THE APP, THE USER AGREES THAT THIS AGREEMENT IS ENFORCEABLE LIKE ANY WRITTEN CONTRACT SIGNED BY YOU. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THE AGREEMENT, DO NOT UTILIZE ANY VERSIONS OF THE APP.

I. Changes to App.

You agree that Beckins LLC may change, modify, update, or suspend the app at any time without notice or liability to You.

II. App Data.

You acknowledge that data may be lost or corrupted at any time and for any reason.  You agree that Beckins LLC will not be liable for any loss or corruption of data regardless of the reason.

III. Changes to the Agreement.

You agree that Beckins LLC has right to change, modify, add to, supplement or delete any of the terms and conditions of this Agreement without notice.

 IV. Warranty Disclaimer.

THE WEBSITE AND THE SOFTWARE IS PROVIDED TO YOU "AS IS" AND BECKINS LLC MAKES NO WARRANTY, CONDITION OR REPRESENTATION (EXPRESS OR IMPLIED, WHETHER BY STATUTE, COMMON LAW, CUSTOM, USAGE OR OTHERWISE) AS TO ANY MATTER INCLUDING, WITHOUT LIMITATION, NONINFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY, INTEGRATION, OR FITNESS FOR A PARTICULAR PURPOSE. YOU ASSUME ALL RESPONSIBILITY FOR SELECTING THE APP, THE SITE AND THE SOFTWARE TO ACHIEVE YOUR INTENDED RESULTS, AND FOR THE INSTALLATION OF, USE OF, AND RESULTS OBTAINED FROM THE APP, THE SITE AND/OR SOFTWARE. WITHOUT LIMITING THE FOREGOING, BECKINS LLC MAKES NO WARRANTY THAT THE APP, THE SITE OR THE SOFTWARE WILL BE ERROR-FREE, THAT THE APP, THE SITE OR THE SOFTWARE WILL BE FREE FROM INTERRUPTIONS OR OTHER FAILURES, OR THAT THE APP, THE SITE OR THE SOFTWARE WILL MEET YOUR REQUIREMENTS.

V. Limitation of Liability.

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER IN TORT (INCLUDING NEGLIGENCE), CONTRACT, OR OTHERWISE, SHALL BECKINS LLC BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR LOSS OF PROFITS, LOSS OF GOODWILL, OR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR GROSS NEGLIGENCE OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR FOR ANY OTHER DAMAGE OR LOSS. 

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, the liability of Beckins LLC and its affiliates shall be limited to the fullest extent permitted by law.

VI. Indemnity.

You agree to indemnify, hold harmless, and defend Beckins LLC from and against all claims or lawsuits, including attorney's fees, that arise or result from Your use or misuse of the App, or violation of any of the provisions of the Terms of App Agreement.

VII. Location.

The Site and the App are operated by Beckins LLC  in the United States. Those who choose to access the Site, and/or the App from locations outside the United States do so on their own initiative and are responsible for compliance with applicable local laws.

VIII. Entire Agreement.

This Agreement represents the complete agreement between You and Beckins LLC concerning the subject matter of the Agreement, and supersedes any prior agreements and representations between You and Beckins LLC.

IX. Reform and Severability.

If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed to the extent necessary to make it enforceable to the maximum extent permissible so as to affect the intent of the parties, and the remainder of this Agreement shall continue in full force and effect.
